Many law firms drafted preservation letters some years ago as firms were grappling with the challenges of electronic discovery and some of those forms could use an update. Electronic discovery expert Craig Ball has shared his New Exemplar Preservation Letter with the legal community. He notes that it should not be considered the perfect preservation letter, but should be used as a template and drafting guide. Craig’s six-page letter lists twenty-one categories of electronically stored information (ESI) that are potentially relevant. So, I am certain many litigators will want to review it.

My friend Craig Ball exemplifies the best in the legal profession. For decades now, he has embraced the path of learning something complex and then teaching his fellow lawyers how to do it. He has helped us all be better lawyers and use legal technology more effectively.
