Revision Proposed for Legal Internships

August 3, 2021

By H. Terrell Monks, Chair

During the July 23, 2021, Legal Internship Committee meeting the committee agreed a revision of Regulation 7 was needed.  Regulation 7 outlines criminal history reporting requirements for an academic legal intern applicant.  A contradiction was found in the regulation regarding the disclosure of matters set aside.  The committee decided matters set aside and expunged records should be disclosed.  The regulation was amended as shown below, followed by an online vote.  Voting concluded on August 2, 2021.  The amendment passed with 5 in favor and 2 opposed.

Regulation 7

Applicants who have been cited for, arrested for, charged with, or convicted of any violation of any law other than a case which was expunged or resolved in juvenile court, or otherwise set aside, must disclose the same on the application.   This disclosure requirement includes all matters that have been expunged, dismissed, subject to a diversion or deferred prosecution agreement, or otherwise set aside.   Copies of the associated arrest report, complaint, indictment, citation, information, disposition, sentence docket report, and appeal, if any, must be attached to the application. (Amended March 27, 2020)

Applicants who have been cited for, arrested for, charged with, or convicted of any violation of any alcohol or drug-related traffic violation, other than a violation that was expunged or resolved in juvenile court, or otherwise set aside, must disclose the same on the application.
