The Oklahoma Bar Association Website is comprised of various web pages operated by the Oklahoma Bar Association, including, without limitation, www.okbar.org, www.okcourtsandmore.org, www.courtfacts.org, MyOKBar, OBA Section websites, mobile websites, microsites, mobile applications, OBA profiles on social media sites, and any other digital services or properties operated or used by the Oklahoma Bar Association  from time to time (collectively referred to as the “Oklahoma Bar Association Website”). By accessing or using the Oklahoma Bar Association Website you agree to comply with and be bound by these Terms of Use (“Terms of Use”). Please read these Terms of Use carefully as well as the Oklahoma Bar Association Privacy Policy.

IF YOU DO NOT AGREE TO THE TERMS OF USE AND THE PRIVACY POLICY, YOU MUST IMMEDIATELY TERMINATE USE OF THE OKLAHOMA BAR ASSOCIATION WEBSITE. YOUR REMEDY FOR DISSATISFACTION WITH THIS SITE, OR ANY PRODUCTS, SERVICES, CONTENT, OR OTHER INFORMATION AVAILABLE ON OR THROUGH THIS SITE, IS TO STOP USING THE SITE AND/OR THOSE PARTICULAR PRODUCTS OR SERVICES. Agreement between User and the Oklahoma Bar Association

The Oklahoma Bar Association Website is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Oklahoma Bar Association Website constitutes your agreement to all such terms, conditions, and notices.

Changes to Terms of Use

The Oklahoma Bar Association expressly reserves the right to change the terms, conditions, and notices under which the Oklahoma Bar Association Website is offered, including but not limited to the changes associated with the use of the Oklahoma Bar Association Website and the Terms of Use, without notice to you. You acknowledge and agree that it is your responsibility to review this site and these Terms of Use from time to time and to familiarize yourself with any modifications. The Oklahoma Bar Association is not responsible for webcasting or any other form of transmission received from any Linked Site. The Oklahoma Bar Association is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by the Oklahoma Bar Association of the site or any association with its operators.

The Oklahoma Bar Association Website includes information that is intended to help users find legal assistance, learn about the law and the legal system in Oklahoma, and submit attorney complaints. This site and the information provided, however, do not constitute legal advice and must not be used as a substitute for the counsel and services that you may require from an attorney authorized to practice law in your jurisdiction. Your reliance and use of the information contained in or linked from this site is done at your own risk. 

No Unlawful or Prohibited Use

As a condition of your use of the Oklahoma Bar Association Website, you warrant to the Oklahoma Bar Association that you will not use the Oklahoma Bar Association Website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Oklahoma Bar Association Website in any manner which could damage, disable, overburden, or impair the Oklahoma Bar Association Website or interfere with any other party’s use and enjoyment of the Oklahoma Bar Association Website. Conduct on the Oklahoma Bar Association Website

  • Conduct or forward surveys or contests unless such Communication Services specifically allows such messages.
  • Forward pyramid schemes or chain letters.
  • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Communication Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Violate any applicable laws or regulations.

The Oklahoma Bar Association has no obligation to monitor the Communication Services. However, the Oklahoma Bar Association reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. The Oklahoma Bar Association reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever. The Oklahoma Bar Association reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the Oklahoma Bar Association’s sole discretion. Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. The Oklahoma Bar Association does not control or endorse the content, messages, or information found in any Communication Service and, therefore, the Oklahoma Bar Association specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Oklahoma Bar Association spokespersons, and their views do not necessarily reflect those of the Oklahoma Bar Association. Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

Electronic Communications

When you use the Oklahoma Bar Association Website, or send emails, and other communications from your desktop or mobile device to us, you consent to receive electronic communications from us, such as e-mails, mobile push notices, or notices and messages on this site or otherwise. You should retain copies of those communications for your records. You further agree that all agreements, notices, disclosures and other communications that we may provide to you electronically satisfy any legal requirement that such communications be in writing.

License to Use Materials Submitted to the Oklahoma Bar Association

The Oklahoma Bar Association does not claim ownership of the materials you provide to the Oklahoma Bar Association (including feedback and suggestions) or post, upload, input or submit to any Oklahoma Bar Association Website or its associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting Submission you are granting the Oklahoma Bar Association, its affiliates and necessary sub-licensees permission to use your Submission in connection with the operation of Oklahoma Bar Association business including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submissions, and to publish your name in connection with your Submissions.

No compensation will be paid with respect to the use of your Submissions, as provided herein. The Oklahoma Bar Association is under no obligation to post or use any Submission you may provide and may remove any Submissions at any time in the Oklahoma Bar Association’s sole discretion.

By posting, uploading, inputting, providing or submitting your Submissions you warrant and represent that you own or otherwise control all of the rights to your Submissions as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

E-Business Transactions

When you purchase products or services through the Oklahoma Bar Association Website, you may utilize a third-party e-business vendor. By utilizing a third-party e-business vendor’s service to purchase products or services from the Oklahoma Bar Association Website, you agree to the third-party vendor’s terms of use.

FURTHER, THE OKLAHOMA BAR ASSOCIATION SHALL NOT BE LIABLE IN ANY WAY FOR THIRD PARTY GOODS AND SERVICES OFFERED THROUGH THIS SITE OR FOR ASSISTANCE IN CONDUCTING COMMERCIAL TRANSACTIONS THROUGH THIS SITE, INCLUDING WITHOUT LIMITATION THE PROCESSING OF ORDERS.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE OKLAHOMA BAR ASSOCIATION WEBSITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE OKLAHOMA BAR ASSOCIATION WEBSITE.

Indemnification

The Oklahoma Bar Association is a judicial agency and arm of the Oklahoma Supreme Court and as such is provided and subject to constitutional and statutory rights, limitations, obligations, and restrictions, including restrictions on the ability to enter into indemnification agreements. By publishing this website, the Oklahoma Bar Association does not waive or escape any such rights, limitation, obligations, and restrictions and does not agree to indemnify any user. Likewise, by publishing the website, the Oklahoma Bar Association does not waive its sovereign immunity. In the event any provision herein should conflict with the protections and privileges the law applies to the Oklahoma Bar Association, the law of the State of Oklahoma and the United States Constitution shall control.   

Termination of Access to Oklahoma Bar Association Website

The Oklahoma Bar Association reserves the right, in its sole discretion, to terminate your access to the Oklahoma Bar Association Website and the related services or any portion thereof at any time, without notice.

General Terms

To the maximum extent permitted by laws, your use of the Oklahoma Bar Association Websites and any and all agreements made pursuant thereto (together, the “Agreement”) are governed by the laws of the State of Oklahoma, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Oklahoma County, Oklahoma, U.S.A. in all disputes arising out of or relating to the use of the Oklahoma Bar Association Website. Use of the Oklahoma Bar Association Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and the Oklahoma Bar Association as a result of this agreement or use of the Oklahoma Bar Association Website.

The Oklahoma Bar Association’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of the Oklahoma Bar Association’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Oklahoma Bar Association Website or information provided to or gathered by the Oklahoma Bar Association with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and the Oklahoma Bar Association with respect to the Oklahoma Bar Association Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and the Oklahoma Bar Association with respect to the Oklahoma Bar Association Website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
