OBA Board of Governors Actions

The Board of Governors of the Oklahoma Bar Association met at the Tulsa County Bar Center in Tulsa on Thursday, April 20, 2006.

REPORT OF THE PRESIDENT

President Grimm noted he granted a one-time exception to the policy prohibiting the utilization of videoconferencing to conduct Board of Governors meetings for this meeting. National High School Mock Trial Championship events were reviewed. He reported he attended meetings of the OBA Strategic Finances Task Force to discuss construction financing, Access to Justice Advisory Committee to discuss the strategic plan, OBA Communications Task Force, OBA Bar Facilities Committee to discuss construction planning for the bar center south entrance and Emerson Hall and the OBA National Mock Trial Task Force to finalize plans for the May event. He met with OTLA member Ted Sherwood to discuss pending legislative bills. He participated in the OBA Law Day event with Chief Justice Watt to recognize Law Day Award contest winners. He attended the Tulsa University law school reception for ABA President Michael Greco and filmed a segment at OETA for the “Ask A Lawyer” TV program. He attended the TCBA Judges Reception, Tulsa Title and Probate Lawyers Association luncheon and spoke to the Ardmore Lions Club about Law Day. He met with OBF President Hal Ellis, President-Elect Mark Curnutte, Past President Judy Hamilton Morse, OBA President-Elect Beam and Vice President Holmes to a discuss tax opinion. He participated in a telephone conference call with Jim Hoyt and Executive Director Williams to discuss the bar center building appraisal. He met with OBA Professionalism Committee Chair Sharisse O’Carroll to review proposals the committee is working on, and he submitted nominees to Gov. Henry for appointment to statutory commissions.

REPORT OF THE VICE PRESIDENT

Vice President Holmes reported he attended the Board of Governors meeting at Roman Nose State Park, mock trial competition at the U.S. Courthouse for the Western District and Closing Banquet of the William J. Holloway Jr. American Inn of Court. He participated in a meeting with Oklahoma Bar Foundation leadership to discuss the Oklahoma Bar Center.

REPORT OF THE PRESIDENT-ELECT

President-Elect Beam reported he attended a Legal Ethics Committee meeting, Watonga board meeting and social events, two Custer County Bar Association meetings, Communications Task Force meeting and several National Mock Trial Task Force meetings. He met with President Grimm, Vice President Holmes and OBF representatives about title issues and also met with Executive Director Williams and Director of Administration Combs on strategic financial planning.

REPORT OF THE EXECUTIVE DIRECTOR

Executive Director Williams shared a copy of the Daily Ardmoreite that featured a story and photo of President Grimm on front cover. He reported during the past month he has attended the Board of Governors dinner and meeting in Watonga, Tulsa University law school visit, TU reception for ABA President Michael Greco and OBA staff celebration. He attended meetings of the House and Senate Judiciary, Access to Justice Advisory Committee, National High School Mock Trial Task Force, Bar Center Facilities Committee and OBA directors. He met with Family Law Section leadership, with General Counsel, Ethics Counsel and Management Assistance Program Director to discuss enhancing the Disciplinary Diversion Program, and with President-Elect Beam on strategic financial planning. He had several conferences with President Grimm and spoke at the Oklahoma Women’s Justice Project.

BOARD MEMBER REPORTS

Governor Caudle reported he attended the OBA OETA Festival event in Oklahoma City, Comanche County Bar Association monthly meeting and CLE, OBA board meeting and social at Roman Nose State Resort, Professionalism Committee meeting and Clients’ Security Fund Committee meeting. He chaired the State Legal Referral Service Task Force meeting. Governor Christensen reported she attended the ABA Women in Law Leadership Conference in Chicago, March board social event in Watonga, March board meeting at Roman Nose State Park, several meetings involving the National Mock Trial Task Force, Bench and Bar Committee meeting and subcommittee meetings, and Bar Center Facilities Committee meeting. Governor Farris reported he attended the OBA board meeting in Roman Nose State Park, Tulsa County Bar Judicial Reception, Tulsa County Bar Auxiliary Barrister’s Ball, TU law school law & medicine society awards presentation, OBA Diversity Committee meeting, Tulsa County Bar Association executive committee meeting and TCBA board meeting. Governor Hermanson reported he attended the OBA Professionalism Committee meeting, OBA OETA Festival event, board social event in Watonga and meeting at Roman Nose State Park, Kay County Bar Association meeting and OBA Member Services Committee meeting. He also sent e-mails to District 1 county bar presidents telling them about Board of Governors actions and encouraging participation in OBA at the Capitol Day. Governor Kennemer reported he attended the board social and meeting at Roman Nose State Resort, two Communications Task Force meetings, Seminole/Hughes counties bar luncheon and Task Force to Create a Uniform Residential Sales Contract meeting. He presented the final draft of the “Oklahoma Uniform Contract of Sale of Real Estate” to the OBA Title Examination Standards Committee at its meeting in Stroud. He said the task force has met for 52 consecutive months, and the contract will be available to the public and real estate licensees in May. Governor Parsley reported he attended the Board of Governors event at Noble House in Watonga, Board of Governors meeting at Roman Nose State Park, two OBA Communications Task Force meetings and two Texas County Bar Association meetings. Governor Reheard reported she attended the March social event and meeting in Watonga and a farewell gathering for Chris Wilson, district attorney for Pittsburg and Haskell counties, who has joined the U.S. Attorney’s office for the Eastern District. She contacted selected judges to discuss judicial redistricting legislation, met with the McIntosh County Law Day Planning Committee and contacted interested attorneys to promote OBA Day at the Capitol. Governor Souter reported he attended a reception for ABA President Michael Greco at the University of Tulsa, a reception for judges at the Tulsa County Bar Association, Legal Assistant Services Committee meeting, March Board of Governors meeting and social at Roman Nose State Park, and the Creek County Bar Association meeting that included a CLE on legal profession-related Web sites.

REPORT OF THE YOUNG LAWYERS DIVISION

Governor Williams reported she attended the March board meeting and social event in Watonga at Roman Nose State Park, March YLD Board Meeting in Oklahoma City and Communications Task Force Meeting in Oklahoma City. She said the division board discussed staffing a booth for the “A New Lawyer Experience” CLE seminar, hosting and attending the swearing-in reception in Oklahoma City, attending the ABA/YLD Spring Conference in Portland, and hosting and attending the new attorney receptions in Oklahoma City and Tulsa, YLD events for the Annual Meeting and upcoming mid-year meeting. She was in communication with National Mock Trial Task Force members regarding assistance needed from the YLD for the event and with YLD committee chairs regarding the status of their committee projects. She also spoke with several members of the public regarding distribution of OBA/YLD volunteers and seniors handbooks. She invited board members to attend one or both of the new attorney receptions - April 27 in Tulsa at the Full Moon Café and May 4 in Oklahoma City at the Bricktown Brewery.

REPORT OF THE SUPREME COURT LIAISON

Justice Edmondson reported the Supreme Court unanimously approved intermediate level discipline for judges. He said the court will promulgate written rules to investigate and administer judicial discipline for misconduct that does not warrant removal from office or compulsory retirement before the end of the year.

REPORT OF LAW STUDENT DIVISION

LSD Chair McGill reported the OLSD has held elections for all of its executive officers and committee members. They also held a programming event at TU and a loan repayment program at OCU.

REPORT OF THE GENERAL COUNSEL

General Counsel Murdock shared a status report of the Professional Responsibility Commission and OBA disciplinary matters. He reported a proposal will be presented on the restitution funds at the May meeting, and a new investigator, Sharon Orth, has been hired to the fill the department’s vacancy.

APPROVAL OF OUT-OF-STATE TRAVEL

The board approved travel for Management Assistance Program Director Jim Calloway to participate in the continuing disaster relief efforts presented by the Louisiana State Bar. The program will be “New Orleans, New Law: Community Revival with Technology” in New Orleans, May 22 and 23, 2006.

AWARDS COMMITTEE RECOMMENDATIONS

The board approved the Awards Committee’s recommendation to present the same awards without changes at the OBA Annual Meeting in November 2006.

RESOLUTION

The board voted to issue a resolution commending the Tulsa County Bar Association on its hospitality to the Board of Governors.

LEGAL ETHICS COMMITTEE RECOMMENDATION REGARDING CREATION OF THE OKLAHOMA LEGAL ETHICS ADVISORY PANEL

Legal Ethics Committee Chair Roger Scott reviewed the chronology of the creation of a subcommittee that reviewed the Legal Ethics Committee’s process for issuing legal ethics opinions. He also reviewed a proposal to create an Oklahoma Legal Ethics Advisory Panel. Following discussion, the board approved several amendments to the proposal, including that the panel would be a panel of the OBA Board of Governors. Past President Harry Woods, Elaine Schuster and Jonathan Burch addressed the board. The board approved the proposal as amended with the panel creation effective June 1, 2006.

PROFESSIONALISM COMMITTEE RECOMMENDATION

Committee Chairperson Sharisse O’Carroll reviewed the committee’s consideration in developing a definition of professionalism. The board approved the definition adopted by the committee - Professionalism for lawyers and judges requires honesty, integrity, competence, civility and public service.

LEGAL ETHICS COMMITTEE RECOMMENDATION ON LEGAL ETHICS ADVISORY OPINION 2004-01

Lynn Moore reviewed the proposed legal ethics advisory opinion regarding provision of ancillary or law-related services. The board approved opinion 2004-01.

APPOINTMENTS

The board approved:

Professional Responsibility Tribunal - Reappoint F. Douglas Shirley, Watonga; David L. Cummins, Hollis; John J. Gardner II, Ponca City and appoint Roger R. Scott, Tulsa, to replace the expired term of J. Patrick Kent, Frederick. Each member will serve a three-year term (7/1/06 - 6/30/09).

District Attorneys Council - Reappoint Cathy Stocker, Enid, to the District Attorney’s Council for a three-year term (6/1/06 -5/31/2009).

Commission on Children and Youth - Recommendation to nominate Deborah Shallcross, Ann Sublett and Tammy Bachman to Gov. Henry for an appointment to the Commission on Children and Youth for a two-year term (7/1/06 - 6/30/08).

INFORMATION ITEM

President Grimm reported he had made the following nomination that does not require board approval:

State Commissioners to The National Conference on Uniform State Laws - Nomination to Gov. Henry to reappoint Duchess Bartmess, Oklahoma City, and Ken Elliott, Oklahoma City, for a four-year term (6/1/06 - 5/31/10).

LEGISLATIVE UPDATE

Executive Director Williams reviewed the status of current legislation. He said a special session is being mentioned.

OBA DAY AT THE CAPITOL

Executive Director Williams reviewed events for Tuesday, April 25.

BAR CENTER FACILITIES COMMITTEE REPORT

Executive Director Williams reported the committee has new estimates for the front entry modifications, which is not unexpected. He said the committee recommends adding lighting and a permanent finish on the handrail, keeping the existing concrete wall at the east end and adding double active doors instead of a single door at the front entry. He said the building permit has been requested, and demolition is expected May 15, 2006. The board approved up to $250,000 to fund the front entry modifications.

EXECUTIVE SESSION

The board voted to go into executive session. They met in executive session and voted to come out of executive session.

ETHICS 2000 REPORT

The board decided to postpone the review of Rule 1.16, 1.17, 1.18, 2.4 and to consider them with the rules scheduled to be reviewed at the May meeting.

JUNE BOARD OF GOVERNORS MEETING

It was noted the new date and time for the June board meeting at the Solo and Small Firm Conference will be 4 p.m. Thursday, June 22, 2006, at Tanglewood.

NEXT MEETING

The board will meet Friday, May 12, 2006, at 9 a.m. at the Oklahoma Bar Center.

This is the correct information that should have been published in the March Board of Governors meeting summary.

OKLAHOMA ATTORNEYS MUTUAL INSURANCE CO. APPOINTMENT

The board voted to recommend to reappoint John Wynne, Enid, and to appoint Ron Main, Tulsa, as nominees to the OAMIC Board of Directors (terms expire 6/1/2009).
