Discipline Conflict Rules Proposed: Member Comment Requested 

The Rules of Professional Conduct Committee has drafted and approved proposed language to eliminate conflicts of interest for current Professional Responsibility Commission (PRC), Professional Responsibility Tribunal (PRT) and Board of Governors members in addition to former PRC and PRT members. No such rules currently exist.

Before submitting the proposed rules to the Supreme Court for its consideration, the OBA Board of Governors is publishing the proposal to allow members the opportunity to comment.

PROPOSED CONFLICT RULE -- PRC MEMBER

1. Suggested location - Rules Governing Disciplinary Proceedings (RGDP) Rule 2

2. Proposed language for current members of PRC

No Commissioner, partner, or associate of the Commissioner shall personally represent a lawyer in any proceeding as provided in these rules during the term of service of the Commissioner on the Commission.

3. Proposed language for former members of PRC

No Commissioner, partner, or associate of the Commissioner shall personally represent a lawyer in any proceeding as provided in these rules if the matter commenced during the term of service of the Commissioner on the Commission.

PROPOSED CONFLICT RULE -- PRT MEMBER

1. Suggested location - RGDP Rule 4

2. Proposed language for current members of PRT                                       

No Tribunal member, partner, or associate of the Tribunal member shall personally represent a lawyer in any proceeding as provided in these Rules during the term of service of the Tribunal member on the Tribunal.

3. Proposed language for former members of PRT

Tribunal members shall not personally represent a lawyer in any proceeding as provided in these Rules for a period of one year following completion of service of the Tribunal member on the Tribunal.

PROPOSED CONFLICT RULE -- BOARD OF GOVERNORS MEMBER

1. Suggested location - RGDP or Rules Creating and Controlling the OBA

2. Proposed language for current members of BOG

No current member of the Board of Governors, partner, or associate of the Governor shall personally represent a lawyer in any proceeding as provided for in the Rules Governing Disciplinary Proceedings during the term of service of the member on the Board of Governors.
