RESOLUTIONS


Submission of Resolutions for 2006 OBA Legislative Program

To comply with procedures contained within the OBA Bylaws, a deadline of Saturday, Oct. 1 has been set to submit resolutions for the 2006 OBA Legislative Program to OBA Executive Director John Morris Williams.

Proposals must be received by the OBA Executive Director to allow publication on the OBA Web site at least once in the Oklahoma Bar Journal at least three weeks prior to the vote. The proposals will be submitted to vote when the House of Delegates convenes during the Annual Meeting Friday, Nov. 4, 2005 at 10 a.m. at the Sheraton Hotel in Oklahoma City.

RESOLUTION NO. ONE: LEGAL REPRESENTATION WITHOUT ENTRY OF APPEARANCE
BE IT RESOLVED by the House of Delegates of the Oklahoma Bar Association that the Association adopt, as part of its Legislative Program, as published in the Oklahoma Bar Journal and posted to the Web site www.okbar.org, proposed legislation modifying 5 O.S. § 5 relating to attorneys performing services for remuneration in pending litigation being made attorney of record. (Submitted by the OBA Access to Justice Committee. Adoption recommended by the OBA Board of Governors.)

RESOLUTION NO. TWO: TAXATION - DATE OF MAILING DEEMED DATE OF PAYMENT OR DELIVERY
BE IT RESOLVED by the House of Delegates of the Oklahoma Bar Association that the Association adopt, as part of its Legislative Program, as published in the Oklahoma Bar Journal and posted to the Web site www.okbar.org, proposed legislation creating new law to be codified as 68 O.S. § 2951 relating to mailing of documents to be deemed date of delivery or date of payment (Submitted by the OBA Tax Law Section. Adoption recommended by the OBA Board of Governors.)

RESOLUTION NO. THREE: ISOLATED OR OCCASIONAL SALE EXEMPTION FROM STATE SALES TAX
BE IT RESOLVED by the House of Delegates of the Oklahoma Bar Association that the Association endorse in principle, as published in the Oklahoma Bar Journal and posted to the Web site www.okbar.org, proposed legislation creating new law to be codified as 68 O.S. § 1360.1 relating to exemption of isolated or occasional sales of property or services, substances or things. (Submitted by the OBA Tax Law Section. Adoption recommended by the OBA Board of Governors.)

RESOLUTION NO. FOUR: CREATION OF PARALEGAL DIVISION
BE IT RESOLVED by the House of Delegates of the Oklahoma Bar Association that Article II, Section 1 of the Rules Creating and Controlling the Oklahoma Bar Association, as published in the Oklahoma Bar Journal and posted to the Web site www.okbar.org, be amended by adding a new subsection to create a Paralegal Division. (Submitted by the Legal Assistants Services Committee. Adoption not recommended by the OBA Board of Governors.) The Legal Assistant Services Committee has withdrawn its resolution.

RESOLUTION NO. FIVE: OKLAHOMA BAR ASSOCIATION STRATEGIC PLAN
BE IT RESOLVED by the House of Delegates of the Oklahoma Bar Association the Strategic Plan, as approved by the Oklahoma Bar Association House of Delegates November 1999 be modified and amended, as published in the Oklahoma Bar Journal and posted to the Web site www.okbar.org. (Submitted by the Oklahoma Bar Association Strategic Planning Committee. Adoption recommended by the OBA Board of Governors.)
